And, So it Begins
Several weeks ago, I ran into my old friend Steve. Unfortunately, we're
more like ‘summer’ buddies since we usually only see each other on the
ballfield when softball season is under way. We’ve been playing together
and against each other for roughly ten years now and it was good to see
his face at our initial league meeting. Naturally, we quickly get caught up
with how each other and our respective families are doing and then he
indicates that he needed to speak with me about something important
after the meeting.






Now, we’ve all done that to someone or have had it done to us. Either
you walk by and say it or e-mail someone or leave a voicemail message.
You're left to fill in the blank. Nonetheless, as the meeting was in
progress, my mind was drifting and struggling to anticipate what Steve
wants to talk about that is so important. Initially, I wondered if it was
about the Fastpitch World Series for this fall, that he has been trying to
drag me to for years. If not, what could it be? I was truly puzzled.
Well, it wasn’t long before the meeting adjourned and our conversation
quickly turned to drag racing. Of course, I was aware that Steve has
been involved in several businesses for a while and was glad to see that
they have been treating him well. Believe me, if it’s one thing that Steve
can do well, it’s talk business and sports to people. On the other hand,
what he didn’t know, was that I love cars...and bikes...and well, just about
anything with wheels and a motor. As a result, our conversation went
something like this:
Steve: Bolky, I’ve put together a little business with my friend. It’s
called ڲŦ© Marketing Promotions and we’re looking to provide a full
service to marketing and promotions for people who don’t have the time
or know-how to get their name out to the fans, media and/or marketing
partners. I was wondering if you could lend your expert knowledge to
the business and write some articles for us.
Mark: ( By now, the creative juices were flowing ) Absolutely !! What did
you have in mind? Maybe a little piece on high-performance small blocks
or maybe something on big block torque monsters?
Steve: Well, no...
Mark: How about something a little more technical, like how cam lift and
duration affects engine horsepower?
Steve: I don’t think that...
Mark: Maybe a little piece on the difference between turbo- and
superchargers? How about that?
Steve: Actually, I thought that since you’re an attorney, you could
provide a column dealing with legal issues and how they might impact
drivers, teams, players, their business, their families, something like that.
( Brief pause while I change the dumbfounded look on my face)
As you might have guessed, the last thing that I expected to hear was a
request for a legal article. In fact, after putting in 60 hours a week doing
legal stuff, I was actually hoping that it would be an article about, well,
cars...or bikes...or anything with wheels and a motor.
Nonetheless, here we are. They asked for it and you’re going to get a
column about legal issues. Of course, I am an attorney and you can
expect that I will provide a disclaimer for the work that I will provide. In
addition, it’s not only a disclaimer, but just good, practical information
about dealing with legal issues and attorneys. Here it is:
